Torts: Serials and Other Multivolume Titles

A guide outlining materials available through the Capital Law Library to assist students with first-year Torts classes.

Description

This list is comprised of multi-volume subscription-based serial titles available in print on the third floor of the library. They tend to go into great depth on their given topic, and typically represent the most probing and comprehensive discussion of Tort Law available.

Please note that unfortunately, many of our subscriptions to multi-volume serials have lapsed, and our Torts serials are no exception. However, since Tort Law tends to not change as frequently or dramatically as some other areas of law, these titles are still adequate for the basic inquiry into the subject required for your first-year classes.

Titles

Shepard's Causes of Action, 2d by West Editorial Staff

Causes of Action is essentially an encyclopedia of prima facie tort actions, with extensive annotations from all fifty states demonstrating real-world fact patterns that apply them. Available on Westlaw as well as in print, it remains the definitive source for answering the initial question of whether or not a given claim is actionable in tort. Our copy, available in the 3rd Floor Main Collection, ceased updating in 2016, but is still perfectly functional for generalized research as individual entries tend to not radically change with updates, usually only receiving new annotations.

 

Modern Tort Law: Liability and Litigation by J.D. Lee

Beyond the advantages provided simply by being a regularly-updated multivolume treatise, this title seeks to differentiate itself from a crowded field of professional-level Torts treatises with frequent incorporation of current practical litigation concerns alongside the traditional discussion of theory and doctrine. The law library's subscription to this title lapsed in 2009, but the currently up-to-date version is available on Westlaw.

 

Damages in Tort Actions by Frederick A. Raffa & Paul M Deutsch

This title, part of LexisNexis' Matthew Bender line of practice treatises, is the premier source on damages in Tort. It is less about the elements of a claim - such things are more the purview of Causes of Action - than analyzing what those claims are worth in a jury verdict, through both compensatory and punitive damages. The law library's subscription to this title lapsed in 2010, but the currently up-to-date version is available on Lexis Plus.

 

The American Law of Torts by Stuart M. Speiser, Charles F. Krause, and Alfred W. Gans

This massive multivolume treatise presents a simultaneously straightforward and exhaustive treatment of its subject, as is common with major scholarly treatises on various subjects. The law library's subscription to this title lapsed in 2020, but the currently up-to-date version is available on Westlaw.
